Overview

Josiah Irvin is a health care regulatory and transactional attorney at Smith Anderson, advising health care providers, investors, and life sciences companies on compliance, enforcement, and transactional matters.

Josiah counsels physician practices and management companies, hospitals, long-term care providers, pharmacies, behavioral health organizations, and digital health and value-based care platforms on structuring transactions and commercial arrangements, federal and state fraud and abuse laws — including the Anti-Kickback Statute, Stark Law, and False Claims Act — and matters involving licensure, corporate practice of medicine, and reimbursement. He has particular experience designing management services organization (MSO) structures and physician alignment arrangements under North Carolina and national corporate practice of medicine requirements.

He also advises pharmaceutical and medical device manufacturers, contract research organizations, and digital health companies on regulatory compliance and transactional matters, including HIPAA, 42 CFR Part 2, information blocking, and data privacy and security requirements.

Prior to joining Smith Anderson, Josiah practiced in the health care group of an international law firm in Washington, D.C. and New York. He enjoys running, spending time with family and friends, rooting for the Tar Heels, and gardening.
