Jackson Moore Discusses AI on GovCon Intelligence Podcast

Smith Anderson partner Jackson Moore appeared on Sam Le’s GovCon Intelligence podcast to discuss Artificial Intelligence in federal government contracting. The conversation covered the legal and compliance risks associated with AI use, the Department of Justice’s $17 million settlement with IBM, and more.

Jackson noted that hallucinations created by generative AI tools (including inaccurate or fabricated facts and citations) heighten the risks for contractors and attorneys, who now are being sanctioned by courts, Boards of Appeal, the Government Accountability Office, and other tribunals.

“If you ask your AI tool a legal question, it will give you an answer, and it may look like a very good answer—but it may be spectacularly wrong,” Jackson noted.

Jackson further discussed how parties can waive confidentiality and the attorney-client privilege by sharing confidential information with open-source generative AI platforms. The conversation also explored the General Services Administration’s (GSA) proposed Artificial Intelligence contract clause.

Jackson focuses his practice on government contracts and resolving business disputes. He advises clients on federal and state government contracting issues, bid protests, requests for equitable adjustment, claims and litigation. He has represented contractors before the Government Accountability Office, the Court of Federal Claims, the Small Business Administration, the Civilian and Armed Services Boards of Contract Appeal, and federal and state courts.
