Federal government contractors, subcontractors, suppliers and employers must prepare to comply with COVID-19 vaccine mandates recently issued by the President and various federal agencies.  

These requirements include:

  • President Biden’s Executive Order 14042, “Ensuring Adequate COVID Safety Protocols for Federal Contractors”;
  • Changing guidance issued from the Safer Federal Workforce Task Force;
  • A new Federal Acquisition Regulation (FAR 52.223-99);
  • Agency-specific implementation that expands the applicability of the FAR clause and Guidance; and
  • Federal facility access restrictions for prime contractors, subcontractors, suppliers, and vendors.

The Emergency Temporary Standard (ETS) issued by the Occupational Safety and Health Administration (OSHA) on November 4, 2021, generally does not apply to federal contractors.  

Employers faced with these changing requirements must consider employee requests for accommodation on disability and religious grounds, answer questions about implementation and consider how to pay for the cost of vaccines and testing.
