Overview

With more than 18 years of experience in complex land use, zoning, and development approvals, Michael Birch has advised on some of the region’s most impactful development projects. He counsels landowners, developers, and businesses through all stages of the development process, including rezoning, site plan review, special use permitting, variances, code interpretations, and zoning due diligence.

Michael focuses his practice on land use, zoning, commercial real estate, and land use-related litigation, regularly representing clients before local governments, planning boards, boards of adjustment, and state agencies across North Carolina. From obtaining and preserving development approvals to navigating complex regulatory environments, his practical approach, strategic insight, and deep understanding of processes and municipal government dynamics make him an invaluable resource to clients.

Prior to joining Smith Anderson, Michael practiced with regional and international law firms, where he cultivated a sophisticated land use and zoning practice in the Triangle region. He is also ranked by Chambers USA for Real Estate: Zoning/Land Use in North Carolina.

An active member of the Triangle community, Michael has served on a number of boards and commissions, reflecting his longstanding commitment to civic leadership, strategic planning, public service, and advancing initiatives that strengthen the well-being of the broader region. Outside of the office, Michael enjoys spending time with his wife, Jennifer, and their four children.
