Overview
Jonathan Lewis is a member of Smith Anderson’s Litigation and Intellectual Property groups. Jonathan focuses his practice on patent litigation, representing clients in complex disputes before district courts, the International Trade Commission (ITC) and the Patent Trial and Appeal Board (PTAB). He advises clients on infringement, validity and claim scope, and he develops litigation strategies tailored to high-stakes patent matters.
Jonathan has 19 years of experience, including seven years at two global and national law firms and 12 years as a primary examiner at the U.S. Patent & Trademark Office (USPTO). He has worked on litigation, trial and transaction teams to protect the innovations, technology and products of many well-known Fortune 100 and 500 technology companies. Jonathan has litigation experience across all stages of patent disputes, including investigating infringement allegations, evaluating risk, preparing and examining fact and expert witnesses and supporting trial and hearing teams. He has experience working on matters involving a wide range of technologies, such as artificial intelligence, software, semiconductors, robotics, vehicle sensors, wearable devices, electromechanical devices, video encoding, displays, wireless technologies, satellites, medical devices, sensors and distributed networks.
In addition to his litigation work, Jonathan’s practice is informed by substantial experience in patent preparation and prosecution, portfolio management and IP due diligence. Before entering private practice, Jonathan worked at the USPTO, where he gained deep insight through examining patent applications and drafting decisions for ex parte appeals and post-grant proceedings at the PTAB.
Outside of the office, Jonathan enjoys spending time with his family, basketball, football, chess, cars, and keeping up with developments in Internet of Things (IoT) tech.

- Counsel for a global technology leader in defending against patent infringement claims for distributed networking in multiple cases in the Eastern and Western Districts of Texas and before the U.S. Patent Trial and Appeal Board.
- Counsel for a worldwide leader in technology and software solutions in defending against patent infringement claims for artificial intelligence, data security and privacy, and encryption in cases in the Western District of Washington.
- Counsel for one of the nation’s largest automakers in successfully defending against patent infringement claims for an advanced driver-assistance system in the District of Delaware.
- Counsel for a global leader in warehouse automation systems in an ITC investigation, successfully showing infringement. After a week-long trial, the judge found the asserted claims were valid and infringed. The Commission affirmed.
- Counsel for a leading health and fitness tech company in successfully defending against patent infringement claims involving wearable devices in the Northern District of California, obtaining summary judgment of non-infringement of all asserted claims.
