New Overtime Rule Blocked by Federal Court - Will Not Go Into Effect December 1

By Kerry A. Shad

Last night a federal judge in Texas entered a nationwide injunction that blocks the U.S. Department of Labor from implementing the new overtime rule that was to go into effect December 1. The court ruled that the Department of Labor did not have the authority to increase the salary level for the "white collar" exemptions to $47,476 or to implement the automatic increases every three years. The injunction will remain in place pending further order of the district court or an appellate court. The court's order may be found here.
