Federal News Network Interviews Michael Anderson on Federal Anti-Fraud Enforcement
Michael Anderson, counsel at Smith Anderson, was recently interviewed by Federal News Network on its daily morning program, The Federal Drive with Terry Gerton, which aired on WFED 1500 AM in Washington, D.C. on Wednesday, May 13. The interview followed a recent Smith Anderson alert Michael authored, “Federal Anti-Fraud Push Puts Government Funding Recipients Under the Microscope,” which examines heightened federal anti-fraud enforcement initiatives and evolving scrutiny of federal grant, contract, and other fund recipients.
During the interview, Michael discussed the federal government’s evolving approach to fraud prevention and enforcement involving grant or fund recipients and contractors, including increased oversight of eligibility requirements, certifications, and compliance controls before federal funds are distributed. The conversation explored how federal funds now come with a fundamentally different risk calculus for recipients, one that organizations must carefully consider before and after fund distribution.
“Historically, federal programs are ‘pay-and-chase’ systems,” Michael noted during the interview. “This task force is inverting that focus more on the front end of enforcement efforts. Ensuring eligibility requirements, ensuring certifications are accurate, and ensuring there are minimum standards for fraud prevention that apply before money goes out the door. So, it's taking what historically has been a pay-and-chase system and making it more of a threshold review.”
He also addressed the Department of Justice’s growing focus on data-driven investigations and the importance of implementing strong internal compliance policies, audit procedures, and documentation practices.
Michael noted that organizations conducting business with federal agencies or administering federally funded programs should ensure appropriate compliance measures are in place and be prepared to explain and document how funds are requested, managed, and spent in the event of government scrutiny.
Michael’s law practice focuses on complex civil litigation and government enforcement matters. Before joining Smith Anderson, he served as Chief of the Civil Division for the U.S. Attorney’s Office for the Eastern District of North Carolina where he oversaw investigations and litigation of a wide range of civil matters, including, among other things, False Claims Act cases, Controlled Substances Act enforcement, and asset forfeiture. His background in both government and private practice gives him firsthand insight into regulatory scrutiny, compliance, and government enforcement.
