Supreme Court of North Carolina Reappoints Smith Anderson Attorney Mike Mitchell to Rules Advisory Commission

Chief Justice of the Supreme Court of North Carolina Cheri Beasley has reappointed Smith Anderson Attorney Mike Mitchell to the Rules Advisory Commission (RAC) commencing on September 27, 2019. The Commission is charged with monitoring the North Carolina Rules of Civil Procedure and the North Carolina General Rules of Practice on behalf of the Judicial Branch and recommending amendments, additions and deletions to those rules for the proper administration of justice. Mike was previously appointed by Chief Justice Mark Martin, who also appointed him to serve on the Commission for the Administration of Law and Justice.

The Chief Justice has issued the Commission a special charge to propose revisions to the North Carolina Rules of Civil Procedure and the North Carolina General Rules of Practice for the implementation of a statewide electronic filing and integrated case management system. The Judiciary’s current DOS-based systems will be replaced with a new integrated case management system that will allow for innovative changes in the functioning of the courts, and e-filing will make the courts more efficient and will provide greater public access. 

Mike is a trial and appellate lawyer with nearly 30 years of experience in business litigation and appellate practice, and has tried cases in all three federal districts in North Carolina, as well as in state courts throughout the state. He is co-chair of Smith Anderson’s Business Litigation team as well as the Intellectual Property Litigation practice. Mike often serves as lead counsel in appellate litigation, with numerous successful appeals before the North Carolina Supreme Court and the Court of Appeals in the last three years. He currently serves on the Eastern District of North Carolina Local Civil Rules Committee and has worked to revise the local rules for the Tenth Judicial District for electronic discovery. Previously, Mike was appointed by Governor Pat McCrory to serve on the North Carolina General Statutes Commission.
