New Stark Exceptions and Anti-Kickback Safe Harbors for Electronic Prescribing and Electronic Health Records

Sean Timmons Authors Article Published in the November 2006 Prognosis

Smith Anderson Partner, Sean Timmons, recently authored an article New Stark Exceptions and Anti-Kickback Safe Harbors for Electronic Prescribing and Electronic Health Records as published in the November 2006 Prognosis. Published monthly as a joint venture by the NCBA's Health Law Section and the N.C. Society of Healthcare Attorneys, Prognosis provides articles and timely information of interest to healthcare lawyers and practitioners.

Promulgated this summer, the final anti-kickback safe harbors and final Stark exceptions regulations present some interesting challenges for implementation. Mr. Timmons' article provides an overview of the competing policies underlying these final new regulations; specific requirements of these new regulations; and practical issues that may affect implementation.
