What Federal Contractors Need to Know for 2023 AAP Compliance

It has been a busy year for federal government contractors complying with new requirements and trying to understand new initiatives from the OFCCP, while still continuing with the past obligations such as filing the EEO-1 and VETS-4212 reports.
Most contractors were not subjected to long-running and demanding compliance reviews due to limited resources and funding at the OFCCP. But contractors had to learn about and comply with the long awaited AAP compliance certification in the first half of the year. With limited resources the OFCCP has taken a new approach to “encourage” more contractors and subcontractors to comply with AAP obligations without actually having to review as many. The most recent semi-annual scheduling list included only 400 contractors. The OFCCP also issued two significant directives covering the review of compensation and changes in the agency’s compliance review process, and has plans for more changes in 2023. While the agency continues to make plans as if they will receive increased funding, they have yet to do so, and the staffing levels are drifting lower limiting the ability of the agency to conduct more reviews, which has been a critical part of its enforcement practices.
