Proposed Changes to the Reassignment Rules and the Stark Regulations

Sean Timmons Authors Article Published in the November 2006 Prognosis

Smith Anderson Partner, Sean Timmons, recently authored an article Proposed Changes to the Reassignment Rules and the Stark Regulations as published in the November 2006 Prognosis. Published monthly as a joint venture by the NCBA's Health Law Section and the N.C. Society of Healthcare Attorneys, Prognosis provides articles and timely information of interest to healthcare lawyers and practitioners.

Mr. Timmons' article provides a brief overview of the proposed changes to both the reassignment rules and the Stark Regulations, as proposed by the Centers for Medicare and Medicaid Services (CMS). CMS intends for these changes to curb perceived abuses related to billing for diagnostic testing. To date, while the changes have generated significant interest, they have yet to be adopted.
