Wayne Maiorano and Anna Osterhout Presented “Lien Law Implications of a Defunct Contractor” at the North Carolina Bar Association’s 2010 Construction Law Program

Raleigh, NC (March 1, 2010) – Smith Anderson lawyers, Wayne Maiorano and Anna Osterhout, presented a session titled: Lien Law Implications of a Defunct Contractor at the North Carolina Bar Association’s 2010 Construction Law Winter Program on Thursday, February 25, 2010.

The session focused on three topics. The first was how to maximize recovery from a defunct contractor using mechanic’s liens in state and bankruptcy court. The second examined the interplay of lien waivers, successors in interest, and title insurance claims. Finally, they addressed false lien waivers and possible recovery due to fraud criminal charges, or constructive trust in bankruptcy.

Maiorano has extensive experience in the areas of construction, contract disputes and commercial litigation, government contracting, insurance and surety and fidelity law. Osterhout, also an experienced lawyer, focuses her practice on bankruptcy, workouts, and creditors’ rights.
