Smith Anderson Prevails in Bid Protest

Smith Anderson recently represented APS Healthcare and Magellan Health Services in their challenge to a contract award by the North Carolina Department of Health and Human Services ("DHHS"). DHHS initially awarded the contract, which involved review of Medicaid spending on mental health and substance abuse services, to the incumbent provider. Smith Anderson studied the written record from the procurement, analyzed the governing law, helped prepare a detailed letter to DHHS setting forth APS's and Magellan's objections to the contract award, and met with agency officials to discuss those objections. Shortly thereafter, DHHS cancelled the contract award and announced that it would rebid the contract.
