Scott Miskimon Co-Authors the 2015 Cumulative Supplement to North Carolina Contract Law

North Carolina Contract Law

Raleigh, NC (July 10, 2014) - For the fourteenth consecutive year, Smith Anderson partner Scott Miskimon has co-authored and edited the annual Cumulative Supplement to his legal treatise North Carolina Contract Law. Scott also co-authored the original treatise, published by Lexis in 2001. The 2014 Cumulative Supplement continues to update the work by analyzing recent case law developments for contracts governed by the common law and the Uniform Commercial Code.

Scott Miskimon explains that “before the publication of North Carolina Contract Law, lawyers and judges would have to spend hours researching a contracts issue with no assurance of finding a definitive answer. However, this treatise puts thousands of cases at the reader’s fingertips and in minutes one can find authoritative answers along with an insightful analysis into the reasoning behind a rule of law."

Cited and quoted by the North Carolina Supreme Court and the North Carolina Court of Appeals, North Carolina Contract Law comprehensively examines the law of contracts as applied by the State’s appellate courts. The treatise includes tables of cases and statutes, indices and more than 4,000 footnotes. Divided into two parts, Part I analyzes the creation and enforcement of common-law contracts such as employment agreements, construction contracts, leases, contracts for the sale of land, options, broker’s contracts and guaranty agreements. In Part II, the authors review contracts for the sale of goods and warranty issues, and analyze the interplay between the Uniform Commercial Code’s Article 2 and North Carolina’s Products Liability Act.  North Carolina Contract Law is available in book form and in the Lexis on-line database.
